1. Agreement to Terms
By accessing or using trysculpta.store (the "Site") or purchasing any product from us, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the Site.
These Terms apply to all visitors, users, and customers. References to "we", "us", or "our" refer to Sculpta. References to "you" refer to you as the user or customer.
2. Products
All products are subject to availability. We reserve the right to discontinue any product at any time. Prices are listed in US Dollars and are subject to change without notice. We make every effort to display product images and descriptions accurately, but we do not warrant that product descriptions or other Site content are error-free, complete, or current.
3. Orders and Payment
When you place an order, you represent that you are legally capable of entering into a binding contract and are at least 18 years of age. By submitting an order, you are making an offer to purchase the product at the stated price.
We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability. If your order is cancelled after payment has been processed, you will receive a full refund.
Payment is collected at the time of purchase. We accept all major credit and debit cards as listed at checkout. All transactions are processed securely through our payment processor.
4. Shipping
We aim to dispatch orders promptly after purchase. We are not responsible for delays caused by shipping carriers, customs, or events outside our control.
Risk of loss and title for products purchased from us passes to you upon delivery of the product to the shipping carrier.
5. Return Policy and Satisfaction Guarantee
5.1 Our Guarantee
We stand behind the Sculpta device. If you have genuinely used the product as directed and are not satisfied with the results, you are eligible to request a refund within 30 days of receiving your order.
This guarantee is for customers who have used the device consistently for a minimum of 14 days and are dissatisfied with their results. It does not apply to change-of-mind returns, returns based on a single or minimal use, or returns where the product has not been used.
5.2 Refund Options
If you qualify for a refund, you have two options:
•  Option A — 100% Store Credit: Receive a full refund as store credit, redeemable on any future Sculpta purchase.
•  Option B — 50% Refund to Original Payment Method: Receive 50% of your original purchase price refunded to the card or payment method used at checkout.
You keep the device regardless of which option you choose.
5.3 How to Request a Refund
To initiate a refund, email us at support@trysculpta.store within 30 days of receiving your order. Please include your order number, the email address used at checkout, a brief description of your experience with the product, and which refund option you prefer (store credit or partial refund).
We will review your request and respond within 3 business days. Approved refunds will be processed within 5–10 business days from approval.
5.4 Eligibility Requirements
To be eligible for a refund, you must:
•  Request your refund within 30 days of your delivery date.
•  Have used the product consistently for a minimum of 14 days (2 weeks) and be genuinely dissatisfied with results. Single or minimal use does not qualify.
•  Contact us via email as described above.
Refund requests made after the 30-day window, for unused products, or where the product has been used for fewer than 14 days, will not be honoured. We reserve the right to decline requests that we reasonably believe are fraudulent or abusive.
5.5 Damaged or Incorrect Items
If your item arrives damaged or you receive an incorrect product, please contact us at support@trysculpta.store within 7 days of delivery with a description and photo of the issue. We will arrange a replacement or full refund at no cost to you.
6. Disclaimer of Warranties
The Sculpta device is intended for personal cosmetic use only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. Results may vary between individuals. We make no guarantees regarding specific outcomes from using the product.
The Site and products are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, to the fullest extent permitted by applicable law.
7. Limitation of Liability
To the maximum extent permitted by law, Sculpta shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or products, including but not limited to loss of profits, goodwill, or data, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or in connection with these Terms or your use of the Site shall not exceed the amount you paid for the product in question.
8. Intellectual Property
All content on this Site, including text, images, graphics, logos, and product descriptions, is the property of Sculpta or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our express written permission.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the applicable jurisdiction.
10. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will take effect immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.
